The phrase 'satellite litigation of the worst type' has rarely been so apposite.

I can see there might be a limited argument where there is misconduct on the part of the claimant's solicitor and there was no proper retainer (oral or otherwise) but otherwise no proper basis for giving the rules an entirely different application than can be properly derived from their construction.
