How does one explain the arbitrariness of this approach to a client and expect them to respect the legal system or deliver reasonable client care. If there are no principles on which to base an assessment of what is proportionate how can the Master have done anything but put a finger in the wind. Fixed costs with consequent injustice now seem inevitable. Where do people seek justice if they cannot eventually get it through the courts? Is justice to become 'unnecessary'?
