Thing is, 9.09, when your firm depends in large or small part on institutional instructions, it becomes very difficult to challenge unreasonableness without fear of driving your client to your competitors. So if, for example, a public body says to you 'I know there's reams of case law that says that we should be seeking to narrow issues in this claim brought against us, but we want to to take every point and guarantee me we'll get to trial with nothing agreed', what are you expected to do?
