@ Shaun Ryan. The argument that a disproportionate amount of crime is committed by Black people is supported by statistics is a self- fulfilling one; numbers of people being arrested, charged and convicted is only evidence against discrimination if you start from the assumption that the criminal justice system is not biased. If you start from a neutral position there is surely a question to answer. If you apply the same tests that are applied in civil actions for discrimination (ie in the Employment Tribunal) you show your comparator, you show less favourable treatment and then it is for the Respondent to prove a non-discriminatory reason for that treatment. If you have a judiciary/ jury who start from the assumption that more crime is committed by Black people/ Black people are more likely to commit crime then its not hard to see how this would unconsciously affect their decisions about issues such as intention and reasonable doubt.
