Perhaps the powers that be should focus on the reasons why more cases are going to appeal rather than the means of reducing delay for all of those appeals. The CPR is a "dogs dinner" and the recent civil "reforms" (I use this word loosely!) have made the situation even worse. has anyone tried understanding Part 36 recently? District Judges have so much discretion when dealing with procedural issues it is inevitable cases are going to up court ladder. There is so much inconsistency at DJ level it is nigh impossible to advise client's on prospects.
