The real problem is stack it high/sell it cheap leagl services. How many of these claims are actually prepared by a qualified solicitor? The profession has allowed itself to be dumbed down by allowing factory firms to trade. I recently had a case where the claim handler told me all about a particular case (one of the ones you learn in your first year at Uni) telling me what it meant. All very frightening nexcept they had got it wrong on every single level. At the summary judgment application the DJ asked why they were there and then ordered them to pay indemnity costs!

we need to look very carefully at the factory firms who appear to do what they like, the SRA should look there
