There is a fundamental problem with the Family Justice system, which this article illustrates. The article is written from the perspective of lawyers and Court professionals. What is needed is a revlution that looks at Family Justice from the perspective of those people who are seeking to use the service, in the way that the Health service has been forced to change from one run by medical professionals who regard patients as part of the problem.
Frankly I'm not sure that getting the Family Justice system to change is achievable which is why we are calling for the abolition of Child Arrangements Orders and replacement with a very clear set of expectations for what should happen in the overwhelming majority of cases when couples separate. Of course there will be exceptions to the norm of shared care - but that is why we have Public Law and we would retain Specific Issues Orders and Prohibited Steps Orders. Inevitably while you allow people to 'grab the children and pull up the drawbridge' saying 'that if you want to see the children take me to Court!!!' no system will ever be perfect but the one we have is obviosly broken and we need to start again
