The £5K general damages within the £10K small claims limit great news for employers, small businesses and councils. They no longer need to claim on their insurance and pay out for injuring employees and members of the public.

Employee: I had the tip of my finger cut off due to you providing an inadequate safety guard on my cutting machine. I have been off work for a month and you haven’t paid me.

Employer: That’s right and I am not going to pay you. I will say the machine was fine and it was your fault.

Employee: But that’s not true.

Employer: You are a manual labourer. You can’t get a solicitor for this claim anymore as your injury is only worth £4K generals max and £7K in total so my insurers are saying we should not pay out. You have zero chance of successfully working out how to prove breach of duty, causation and quantum and win in court.

Employee: But that’s not fair I can’t pay my mortgage this month.

Employer: There are food banks available. Now get back to work you snivelling wretch.

Even better news for claims from women who are more likely to be part time so less likely to have a loss of earning claim that will take them over £10K
