The seeds of destruction were sown by the law society and its lack of leadership
1. The law society approved referral fees which led to CMC’s and we know what trouble they have caused. Did the law society ever stop to think that other professional bodies don’t allow referral fees?
2. The massive costs claimed under no win/no fee. The law society took no action whatsoever on firms claiming massive costs for acting on a typical whiplash claim. The money made by these firms was obscene until the Government took action.
3. There was a crying need for reform but the problem was the law society was absent and it was left to government to take action e.g. abolish referral fees.
