We'll find out when judge Meron makes his ruling. To date MICT has appeared trapped - unwilling to either move judge Akay from the case, or release/clarify Ngirabatware's status - also being aware that there is a principle of judicial independence at stake (Akay cannot be contacted to discuss the matter, which Meron stressed as important here).

So, it is stuck. Not least, the appeal is based on new evidence that all involved agree should be tested.

From another perspective, the government of Turkey, which has not charged Akay or allowed counsel or the tribunal to have contact with him, could of course resolve the problem at any point.

An important case to keep tabs on, whatever happens.
