Not read the judgement yet, but surely the principle that you follow the insurance policy was rejected by the House of Lords in that ancient vicarious liability case of Morgans v. Launchbury. Hopefully on appeal the Court will reject this simplistic solution. Conveyancers cannot be expected to underwrite the risks in the conveyancing process made all the easier by public access to the register.
