Amendment to 14:18 :-

The rules say costs on the standard basis is the usual rule unless unjust to do so. Based on the quotes above the Judge seems to have incorrectly considered the usual rule to be costs on the indemnity basis unless unjust to so.

The onus is on the Claimant to suggest standard basis costs would be unjust, and "the Defendant accepted out of time" alone obviously won't cut it or the usual rule would be indemnity costs.
