As a D I'm happy with the way claimants are pushing an agenda which can only hurt them as, in my experience, it's claimants who accept D offers out of time on a regular basis. Claimants greed on costs has already caused them pain via fixed costs so I do wonder how stupid they have to get now they're pushing this agenda. Bring it on. Only proviso is that offers have to be made at fair times e.g. if reasonable for D to get own medical evidence but it agrees with claimant's evidence and part 36 acceptance follows, indemnity costs shouldn't.
