Why on earth in the 21st century should the State and its judges have the right to deny anyone the right of immediate, permanent legal separation from their spouse?
It should be: Go to the registrar and ask for divorce. Registrar notifies spouse, who has 4 weeks to agree or object, with reasons. No objection: divorce decree. Financial objection: arbitration or court action. Fate of children: court. Why should the divorce hang on either matter? The fate of the children is likely to be made worse if they become bargaining chips over the divorce.
How can lawyers, esp judges, not get this through their heads? The freedom of each party is a Human Right, surely? Oh, sorry, that's overridden by marriage being 'sacred', according to some prophet.
