A family solicitor is quoted as saying the case - a family court ruling which said a wife could not divorce her husband. - ‘clearly demonstrates why no-fault divorce needs to be introduced. It does nothing of the sort. The Court below simply applied existing law and concluded that the grounds for divorce relied on in that case were not made out. Whether there should be an evidential burden attaching to the dissolution of a marriage contract, entered into with solemn vows and promises, is for Parliament to determine and is not a question the answer to which should inform the Court’s judgment. Next thing you know, the Judge will be being headlined ‘the enemy of the people’.
