'Simons saw no evidence of planning to decide the necessary work for the case, which the solicitors knew was going to be worth no more than £5,000'.

Is this not the key? If solicitors knew the claim was not worth more than £5,000, then why did they (both) run up ridiculous amount in costs. Why was a Part 36 for at least £5000 not made even prior to the commencement of proceedings? Wholly disproportionate. My view is that the sum awarded in costs is still extremely generous.
