My admittedly limited experience of DoLS is completely the opposite of what is reported.

A sectioned family member was put into a home but then released as a result of being moved onto DoLS. Everyone involved with capacity (family, medical practitioners, social care, care home) believed a release would be disastrous. Low and behold there was a massive deterioration in health resulting in a second sectioning and shortly thereafter death.

The DoLS case worker suggested that they knew a release would not work but that "they had to do what the patient wanted".

DoLS appears to be too interested in what a patient wants and not what they need. Releasing people without the capacity to function on a day to day basis because "they want to leave" (of course they do, they lack capacity to recognise that they're not capable!) is as good as murder.
