This argument, whilst entirely correct and logical, fails each and every time it is raised. Remember LASPO and the introduction of the portal? Of course, claimants and their lawyers want the underlying causes EL, PL, OL, disease, and med neg claims to be reviewed, assessed and fixed so that accidents never happen again. But the argument falls on deaf ears - by insurers, defendant solicitors, and by government. For them, it is better to fix the lawyer's costs, de-skill the industry and process-drive the system into oblivion, rather than fix the underlying problems.
