Anon 3.27, hit the nail on the head. SRA are aggressive and unaccountable - just after a win at any price. They have no logical approach, act and behave without regard to proportionality or humanity. Generally their approach is totally disproportionate and appear to have totally lost the respect of the professsion. How can they be in charge of upholding the standards of the profession when they themselves fall seriously short, are unregulated themselves and behave and act without any regard to reasonableness or proportionality?
Agreed that regulation is absolutely necessary but it should be proportionate and humane with a common sense approach.
The SRA's panel of solicitors are also not helping. But then why should they care if they are paid their hourly rates without having to justify? And SDT does not help either - they should make the SRA and their solicitors more accountable for costs of the respondent in the event of the SRA losing, it is very rare indeed that the respondents are awarded costs and this is creating a culture where the SRA are totally unaccountable and bringing nonsensical cases before the SDT.
It's about time the whole system is examined and perhaps it's time to disband the current SRA and have in its place a regulator who commands more respect rather than fear.
It would appear that the SRA no longer command the confidence or respect of solicitors.
