Chances are that if you find that your lawyer does not understand the intricacies of your business, it is because whoever has been instructing them either does not understand or is unable to explain the intricacies for your business.

In my experience, being "commercial" generally involves starting with the assumption that your client does not understand what they are trying to do or why and them leading them on a journey of discovery which will hopefully end in a set of meaningful and workable instructions.

Not always possible of course - you always get some clients who insist that they are paying for a contract and expect to get a contract - and woe betide the lawyer who has the temerity to ask what the contract should actually say...
