What is a client to do when his solicitor drags a fire damages claim out for 7 years only to have it struck out on the grounds of "inordinate and inexcusable delay"?
Surely a court order striking the action on those grounds is sufficient to prove negligence? So why does the SCB/SRA/OSS or whatever name the department handling complaints comes under at the whim of the Law Society, maintain that the client ought to take legal action against the solicitor for negligence? Oh! I am terribly sorry, the Law Society or whatever body deals with complaints only handles cases of "misconduct" and not cases of negligence even though they have a "negligence panel.
