The SRA proposals are supported by the Competitions and Markets Authority ! That speaks volumes. CMA's brief is to strengthen business competition and prevent and reduce anti-competitive practices.
We are viewed always as anti - competitive and hence the proposals which are flawed and ill-conceived;
So the public will have different protections whether the solicitor is in a regulated firm or not - the SRA will helpfully give us a sticker for our windows and a simple handout guide - good luck with that - the public don't understand non-reserved legal activities at present ( note there was not one contribution to the consultation by a member of the public so clearly a matter of desperate concern !)
Unregulated firms will hire individual solicitors( and market the kudos of that in their selling) and the hapless solicitor will then have different obligations on him than the firm - the SRA can intervene with him or her but not the firm ! Add in company law and employment contracts and you've got a complete dogs breakfast . The SRA need to remind themselves one can't serve two masters.
