The reverse incentive to proceed to trial has already occurred - by introducing eye wateringly low fixed costs.
We have more cases going to trial now than ever before, the only reason I can see is that defendants might as well have a punt.
We're not helped by these judicial inconsistencies, we're making Part 36 offers, but even when we beat them at trial, its a lottery whether we see compensation enhancements or costs benefits.
