"Harman also questioned whether those emails can now be published."

A better question would be "why can the emails not be published?". There appears to be nothing in the SDT's rules which involves an express or implied undertaking not to disclose material deployed at a public hearing; and the SDT has not made an order prohibiting disclosure.

So, let's see the emails. If the SRA won't produce them, let's hope Harman makes an application for disclosure of them when the costs hearing comes round.
