As far as I can tell from a quick skim read, the costs figures they are using for Claimants must be overall costs, including VAT, expert fees, court fees, etc... - or at least, I couldn't see separate figures anywhere.

ps - You may notice that a curious absence from this article is anything about the discount rate - why aren't the NHSLA/NHSR making a big fuss about that, similar to the howls of protest from the insurance industry and the MPS? Well it's because last year, the treasury told the NHSLA to change discount rate they use for internal purposes from 2.2%, down to -0.8%, doubling the estimated overall burden of all claims.
