Because the NHS as an institution doesn't have the propaganda/lobbying money/clout of the ABI and because the various defence organisations/unions don't have the money to throw around for propaganda and lobbying.

That and clinical negligence is unfortunately very front-loaded to establish if a claim should actually be brought, so there is perhaps an understanding as to why the fixed cost have to be "right" rather than just allowing "peanuts".
