So one unnecessary evil of the Employment Tribunal system has just been removed!

However, the greatest failing still exists e.g. the ‘Burchell Test’ in Unfair Dismissal claims which only requires the Respondent to have a ‘reasonable suspicion’ of wronging on the part of the Claimant rather than actual concrete proof of misconduct. This in effect frequently deprives Claimants of a fair hearing and as such, violates the European Convention on Human Rights. But how long will it take, how much money will be spent as well as how many Court hearings will be required before this great injustice is eradicated?
