Stefan and many other colleagues will no doubt recall the circumstances in which a case management order was made in earlier examples of large scale litigation. The lengthy and sometimes stressful negotiations between the parties representatives in order to identify the legal issues and the different factual permutations to which each issue might relate.
This earlier procedure is to be compared with the smooth unilateral efficiency of the modern case management process; which yields priority to administrative convenience over forensic analysis.
Professor Doyle Is as aware of the potential issues as other experienced colleagues, and I am sure that he has his reasons.
This is the time to make lists, send letters before action requesting preservation of files and tool up for a lot of document and data processing. For the time being the limitation clock is only ticking against the MOJ.
