All of this is fine until your trial is listed before His Honour Judge Pedant - who at the beginning of the trial says: 'I've read the bundles lodged and I've noted references to the following documents that are not in the bundles. I'm adjourning to allow the parties to compile comprehensive bundles and I'm reserving the costs occasioned by this and the necessary adjournment'. Too often, in litigation, you're damned if you do and damned if you don't. The only mitigating feature is that equally often the judge hasn't read the bundles before trial and so won't be aware of that which has been excluded as not obviously relevant to the issues to be determined!
