This article suggests that there will be a significant number of claims. For arguments sake, lets assume there were more people than not that failed to advise in relation to the rent provision. If the standard in negligence is whether a reasonably competent professional would have acted as such, is failing to advise negligent? If the majority didn't do more than bring this matter to the attention (without saying more), is there arguably no breach of duty or it is whole scale negligence? I am posing a question rather than an answer. Interesting to see how it develops.
