See the full judgment - the judge quite clearly criticises the approach taken by both the Deputy and full District Judge in refusing the order. I had noticed in recent years that District Judges will occasionally question their power to make orders that go beyond the ordinary - one referred to possible criticism by the DCJ which suggests that there has been some behind the scenes activity on the issue over the last few years.
