Again, an example of inconsistency by the SDT. As others have said, other solicitors have been struck off for lesser offences. Indeed you can avoid being struck off, it seems, for trying to murder a couple of family members.
What I can't understand is that:
1. His client had been chased numerous times and hadn't bothered to sign the statement.
2. It's said his client was aware of what was being done. How? And if he had given instructions about his solicitor signing his own statement, why didn't he sign it himself?
3. It's not said that the two witnesses were aware of what was going on.
The simple answer would have been to apply to the Court to remove yourself from the Court record as not being in receipt of instructions from your client. The claim would not then have succeeded, unless someone else took the claim on and applied for relief, but if the blame lay with the client and witnesses not signing statements, that's not the solicitors' fault.
