I'm hardly ever on the side of defendant insurers mainly because nowadays they mostly ( I had a notable exception today) behave in an horrific manner to genuinely injured and fundamentally bent claimants with the same rabid passion. However, if a Judge thinks that he is being told a load of lies and hears the evidence to prove it to his satisfaction, why on earth shouldn't he say so? Its all a bit of a shame that the insurers decided to follow the american hardball route in the first place many years ago, and so, along with the government and their totally un- informed no win no fee insanity, let the thieves into the temple. Let's kick the thieves out and cure insurers of their hydrophobia. It will all be a better and cheaper environment as a result.
