The Defendant is often the insurer with the driver as a witness. It may be that you work for one of the better insurers/defendant firms and that your Defences are legitimate and based on the facts as presented by your driver/client.

But all too often Defences are innuendo and out right lies from certain defendants. One strongly suspects in many cases that the actual driver has never seen the Defence let alone said half of the things in it. Consequently a lot of those claims settle at witness exchange unsurprisingly.

I don't really understand your position though Anon 17.49. Surely if a Defendant is dishonest there should be consequences? Even if it is rare in your view. I don't see how you can suggest that only Claimants should be required to tell the truth in proceedings.
