It is the old tussle between actual de facto litigation privilege (when proceedings have been commenced), covering lawyer-client-expert correspondence, and objections to disclosure due to purported privilege (i.e. dressing up and attempting to put a cover of privilege on something outside anticipatory correspondence with lawyers and experts which is arguably privileged).

This tension will never go away.
