The MOJ' have said this before. I too read that as meaning Fees v2 isn't ruled out. However, given the SC focused on the effect on low value claims, under £5000 as I recall, which most/many ETs are, it would be very difficult to introduce lawful fees, other than at a nominal level. And there were multiple, stringent hurdles placed upon them in the SC judgment. The current government is so weak, divided and its resources preoccupied with Brexit for years to come, it would be a further miscalculation to take the controversial step of trying to reintroduce fees. Further, it won't happen under a labour government, which is perhaps a 50:50 prospect as matters stand.
