Anon at 12:01, the problem is that at the point that they are being asked their nationality they are not criminals. They're the accused and innocent until proven otherwise.

Why waste taxpayer money setting the wheels in motion before they're convicted when they might be acquitted? There are enough backlogs as it is in booting out those that are due to be booted - why squander scant resources on the chance an accused might become a convicted with a sufficiently serious sentence to warrant a booting?

Why even bring up nationality before the conviction and sentencing and thus give the impression that the knowledge may in some way influence the outcome?

Once convicted and sentenced - fine, boot away; I'll help, take my boot. Until then however, it's premature, gives the impression at least of being prejudicial (if not potentially being so) and is a waste of money and resources.
