Anon @15:33: it is a difficult area! You have not quoted the full definition in the Equality Act, which goes on to explain that (in relation to whether the conduct had the relevant effect) the perception of the recipient should be taken into account, as should the question of whether it is reasonable for the conduct to have had that effect.

So, in your receptionist example, in my view the answer could legitimately be different depending on your perception of the effect of the comment from a man, rather than a woman.
