You rightly highlight that the statutory language (violation of dignity; creating an intimidating, hostile, degrading, humiliating or offensive environment) screens out trivial events or minor upsets.

In addition, under the legislation, there is a balance to be struck. Yes, the perception of the recipient should be taken into account. But so should the question of whether it is reasonable for the conduct to have had that effect.

So, however proper we may consider our own motives to be, it is worth considering how our words or actions might be perceived by someone else: dare I say it, perhaps even someone of a different generation or cultural background.
