The judgment clarifies much of the below - the judge found that the effect of the letter was to vary the 21 day period to 7, even though it may have been an error (the older version of 3.13 provided for a 7 day period), but that not every court letter could be signed off by a judge and an application for relief was not required. If he was wrong in that he applied the Denton tests and concluded that relief should be granted - no prejudice and good reason for the delay (the letter). The issue was dealt with at a CMC, so presumably the costs award is limited to the additional costs incurred as a result of the application. It was not a stand alone application, so the figure is probably within reason.
