Without availablity or production of time recording ledger how can the Solicitors bill of costs can be assessed at Summary/Detailed Assessment. Surely the costs Judge requires sight of this. The same applies to correspondence to the other sides Solicitors such as Part 36 Offers etc to decide on Indemnity costs issues. I have an order for Costs against the losing Claimant and I would like to include my previous Solicitors Costs in my Costs but my previous Solicitors are relying on the Green case and refusing to give the information. Surely it is in their interest they provide the information requested. I also have a professional negligence claim and wasted costs arguments against my previous Solicitors.
My view is that Green can be distinguished to the present facts.
