Presumably the point here is that despite there being no discernible difference in the intellect of these candidates, BAME candidates still score lower on the LPC.

Nobody is suggesting that law firms are responsible for this or that the SRA should introduce a form of positive discrimination to counter this.

The profession may nonetheless benefit from understanding if there are external factors which influence the BAME candidates ability to perform to their fullest ability on the LPC.

Identifying and remedying these potential barriers will hopefully lead to a higher BAME pass rate on the LPC. This in turn means that there will be a greater pool of talent for law firms to recruit from. If law firms are recruiting in a manner that respects diversity, this will in theory help towards a scenario where we have a more accurate and just representation of BAME in law firms.

Surely that is more desirable than ‘positive discrimination’ where equality equates to quantity rather than quality.

The problem is that a part of the profession will read an article like this and jump straight onto the “outraged” bandwagon at what they perceive to be a liberal left agenda. That is simply counter productive.
