They are raising challenges when there has been no incorrect deduction, and in some cases where there has been no deduction at all.

In many cases where we make a deduction the success fee is 0% and the deduction reflects the difference between solicitors own client costs and inter partes costs.

For matters in the Portal it does not take an awful lot for there to be a shortfall between SOCC and portal costs.

These proceedings are not the only way of challenging a deduction from the damages, we have the odd client who raises a complaint when they (not having listened to us at the outset or read their client care letter, or indeed any other relevant correspondence) get their settlement break down.

Many times they'll dress up their complaints about the deduction with other complaints (it took too long (yes, we had to wait 8 months for a stage 3 hearing)) but in reality they are just having a pop so that they can try and reduce their liabilities.
