As a Claimant PI practicioner I agree with the decision of Knowles J.
It is also the reason why these large scale changes being introduced at the whim of insurance companies are not necessary. This case and the resultant appeal show that insurers already have remedies available to them to get dodgy claims dismissed and get their costs paid too.
