It's the imbalance that strikes me as the most troubling issue here. I've sat behind counsel for a Claimant when a director of the Defendant company admitted that documents proffered in support of their Defence were fraudulently created. That sort of abuse of the system only resonates in costs; it cannot defeat a Defendant's entire pleaded case. Why is that?
