What has not been highlighted in this report is the fact that these changes were only ever put in place because legislation made them mandatory. This legislation was put in place following the Hutton report which concluded that we could not afford the pensions schemes as they currently were and the discriminatory regime was sanctioned by the govt in order to soften the blow for those closer to retirement who may not be have time to do anything to mitigate a sudden loss in expected income (unlike younger people with longer left to work). So it is nothing to do with discriminating against judges (or women, or BAME etc) - it is simply trying to give effect to the govts' decision to save the taxpayer paying for something we can no longer afford
