Any lawyer worth his/her salt is already fully engaged in ADR. I rarely come across a legally represented party who is not prepared to make at least one offer of settlement pre-issue of proceedings. That is all it would take for me to demonstrate that an effort to compromise has been made and, provided the required pre-action protocol / PDPAC has been followed, there should be no barrier to issuing a claim. In most family and chancery cases the Courts (in Leeds and Manchester at least) are already building in "financial dispute resolution" hearings at an early stage, which double up as directions hearings and are helpful in my experience.
