Mediation would be more acceptable to me if the negotiated outcome was legally binding, once agreed by both parties. That way the conciliator in the dispute to compensate the other side can't pull out without suffering the consequences. At present, anything they decide can later be disregarded - at some expense to the ADR proposer. Their behaviour can't even be used against them if the matter does eventually go to court.
