As a mediator I declare a vested interest. However, so should the Law Society. It should be possible to find a middle ground. There is a huge appetite for mediation which can offer solutions that a Court cannot and can save enormous costs. Compared to Legal costs of an action, mediation represents good value for money. We are finding with the Manchester Mediation pilot that just a nudge from the Judge to encourage people to mediate helps to get over the “sign of weakness” issue. It has already been established in law that compulsory mediation does not restrict access to justice. It is a different way to achieve justice. As a result of inequality of arms, with deep pocketed litigants, a full litigation process sometimes does not achieve justice in any event.
