Reply to anonymous at 13.21. The case in question is now 6 months old. The Client in question rejected both offers so thankfully we have no loss to pursue Haven through the Courts about. I didn't expect a response from Haven but complaining to them and not getting a response was I thought a pre-requisite to my complaint to the FCA. Funnily enough I only this morning heard from the ICO in response to my complaint to them. Both my complaint to the FCA and the ICO were made in accordance with the Portal guidance. The ICO say they don't know why the Portal advises people to complain to them and they don't consider any breach of the DPA to be involved. So the guidance on the Portal is not only advisory but incorrect according to the FCA and the ICO.
